NOTICE OF ADOPTION OF ORDINANCE NO. 2020-25
HARDSHIP DEFERMENT ORDINANCE
To the residents and property owners of the Township of Armada, Macomb County, Michigan, and all other interested persons:
On January 8, 2020, the Township of Armada (the “Township”), in Macomb County, Michigan, adopted Ordinance No. 2020-25, Hardship Deferment Ordinance (the “Ordinance”). The following is a summary of the Ordinance. A true copy of the Ordinance is available for inspection at the Township Hall during regular business hours at 23121 East Main Street, Armada, MI 48005.
Section 1. Purpose. This section states the purpose of the Ordinance.
Section 2. Definitions. This section defines “hardship”, “principal residence” and “income” for purposes of the Ordinance
Section 3. Applications for Hardship. This section provides the process for submitting an application for a hardship deferment and the documents required to be submitted.
Section 4. Determination of Hardship Deferment. This section provides eligibility standards for a hardship deferment and the process for Township review of hardship deferment applications.
Section 5. Deferment. This section provides the duration of a deferment and conditions thereof if a deferment is granted.
Section 6. Termination of Deferment. This section provides that upon termination of the deferment of a special assessment, the deferred payments become immediately due and payable with interest.
Section 7. Lien. This section provides that any deferred assessment constitutes a lien against the subject property until paid. The lien, if not paid when due, is collectible in the same manner as delinquent special assessment by placement on the township annual tax roll.
Section 8. Severability. This section provides that the provisions of the Ordinance are severable. If any provision or section, or any part of any provision or section, is declared invalid or unconstitutional by any court of competent jurisdiction, that decision will not affect or invalidate the remainder of the Ordinance, which will remain in full force and effect.
Section 9. Effective Date; Repealer. This section provides the effective date of the Ordinance and that any ordinances or parts of ordinances in conflict herewith are repealed to the extent necessary to give this Ordinance full force and effect.
