AN ORDINANCE TO AMEND SECTION 13.01, 16.46, AND 20.01 TO THE TEXT OF THE ARMADA TOWNSHIP ZONING ORDINANCE NO. 114, PROVIDING FOR THE REGULATION OF PET CREMATORIUMS; PROVIDING FOR REPEAL OR SEVERABILITY; PROVIDING FOR PUBLICATION AND EFFECTIVE DATE.
ARMADA TOWNSHIP ORDAINS:
Armada Township ordains that Zoning Ordinance No. 144 is amended per section 13.01, 16.46, and 20.01.
SECTION I. ORDINANCE AMENDMENT.
Sec. 13.01: Special Land Uses in the B-2 District
M. Pet Crematoriums (Section 16.46)
Sec. 16.46: Pet Crematoriums
A. Pet crematoriums may be permitted as a special land use in the B-2 district, subject to the following regulations:
1. The pet crematorium must comply with all state and federal regulations in addition to the performance standards in zoning ordinance Section 5.05.
2. All vents and other appurtenances accessory to pet crematorium equipment must be concealed from view from all property lines.
3. All activity relating to deceased animals must be handled discreetly and screened from public view to the greatest extent possible, including but not limited to, animal remains’ delivery and storage.
Sec. 20.01: Definitions
PET CREMATORIUM: A dedicated area within an enclosed building where animal remains are cremated.
SECTION II. SEVERABILITY.
This section provides that any unenforceable section can be severed from the rest of the Ordinance.
SECTION III. REPEAL OF CONFLICTING ORDINANCES.
This section provides that all Ordinances or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect.
SECTION IV. SAVINGS CLAUSE.
This section provides that adoption of this Ordinance does not affect proceedings, prosecutions for violation of law, penalties and matured rights and duties in effect before the effective date of this Ordinance.
SECTION V. PUBLICATION.
This section provides that the Clerk for Armada Township shall cause this Ordinance to be published in the manner required by law.
SECTION VI. EFFECTIVE DATE.
This section provides that this Ordinance shall take full force and effect upon seven (7) days after publication as required by law.
