A regular meeting of the Charter Township of Oakland Board of Trustees was called to order on Tuesday, May 24, 2022 at 7:00 PM in the Township Hall, 4393 Collins Rd, Rochester, MI.
PRESENT: Dominic Abbate, Supervisor; Robin Buxar, Clerk; John Giannangeli, Treasurer; Jack Elder, Trustee; Andy Zale, Trustee
ABSENT: Dave Mabry, Trustee; Lana Mangiapane, Trustee
THE FOLLOWING MOTIONS WERE MADE AND PASSED:
1. To approve the agenda as amended.
2. To approve the Consent Agenda as read.
3. To approve the resolution to grant local approval of the Class C liquor license for Detroit Sports and Entertainment LLC for the premises located at 4822 North Adams Rd, Rochester MI, conditioned upon the parties agreeing to the Township’s standard agreement to place reasonable conditions upon the sale and transfer of the license for 5 years.
4. To delay consideration of the application for a Class C liquor license approval for Adam’s Pub LLC until the applicant has satisfactorily addressed the concerns raised by Country Creek Commons LLC regarding the required property interest and authority to operate at the proposed location. Applicant should return to the Board with satisfactory concerns addressed by the next Board meeting on 06/14/2022.
5. To approve the proposed text amendment to Zoning Ordinance Article I General Provisions; Section 16-109 Administration, Zoning Compliance and Enforcement.
6. To approve the purchase of 5 sets of turnout gear from West Shore Fire Inc. per the attached quote in the sum of $14,395.00 from account 206-901-980.342.
7. To approve to contract with B.A. Trainer for a cost not to exceed $12,587.80 and if necessary, a maximum amount of $2,400 for under-ground survey, from HDC Operating for Capital Improvement CLF Restoration #270-901-975.005 and to authorize the Township Manager Kline to sign the contract for the work.
8. To approve the request for a variance to the land division width requirement, as the proposal would not alter the character of the area, subject to the following conditions: 1) That no further divisions of either of the two parcels shall be permitted; 2) That the petitioner agrees to abide by and comply with all pertinent codes, ordinances and standards of Oakland Township, Oakland County and the State of Michigan.
9. To amend budget line 213-752-805.000 to $28,900.
10. To amend budget line item, Design Engineering Services 213-752-805.020 to the amount of $33,600.
11. To approve the budget amendment to line item 213-752-974.755 Land Preservation and Development to the amount of $112,200.
12. To adjust line item 213-752-805.010 Acquisition Professional Services by a reduction of $10,000.
13. To reduce line item 213-752-805.050 Stoney Creek Ravine Nature Park Professional Services in the amount of $10,000.
14. For a reduction to line item 213-752-993.000 Interest Expense in the amount of $508.06.
15. To approve PEA OA09-19R1 for property line staking at the Fox Nature Preserve, Lost Lake Nature Park Expansion parcel for a lump sum not to exceed $25,300.
16. To recommend for approval the acceptance of the 2022 Oakland County CISMA Invasive Species Control Grant invasive shrub control in Cranberry Lake wetland Cranberry Lake Park with onsite supervision from land stewardship team. Starting with just doing Cranberry Lake at this time, with no tree removals or brush hogging and only in the mapped pink areas shown in the BOT packet from 05/24/22.
17. To comply with Michigan Natural Resources Trust Fund Grant agreement recommendations, approval to obtain bids for the removal of the following pre-existing non-recreation uses located at 1401 Lake George Rd in the Fox Nature Preserve: 1 ranch single family residence, 1 garage, 2 smaller farm structures and include the salvaging of any worthwhile materials.
18. To approve Resolution 22-07 A Resolution Regarding Amendment 3 to Michigan Natural Resources Trust Fund Agreement for Paint Creek Junction Northern Trailhead Project TF18-0098.
19. The land stewardship team for Parks & Recreation would be allowed back on the property at the Fox Nature Preserve to attend to any pick-up of small trash, completing the garlic mustard scan, documenting any large trash that needs to be addressed, do any phragmite follow-up work, spread native grass seed and native plantings. There will be no allowable tree cutting, brush hogging or mulching of any sort. The mowing of grass on the trail paths is permitted, but no greater than 10’ wide.
