On August 10, 2022, the Township Board of the Township of Armada, Macomb County, Michigan, adopted the Waste Collection and Disposal Ordinance establishing and implementing a program for refuse collection and disposal by a single waste hauler for all single-family generation sites within the Township, providing for the selection of a waste hauler and for services to be rendered by the waste hauler, establishing collection procedures and prohibiting the unlawful transportation of refuse. The Ordinance includes the following Sections:
Section 1. Short Title
The Ordinance shall be known as the Armada Township Waste Collection and Disposal Ordinance.
Section 2. Findings and Purpose
The Board has determined that a single waste hauler collection and disposal program for single-family generation sites will protect the public health, safety and welfare of the Township.
Section 3. Enabling Authority
The Ordinance is adopted pursuant to Act 451, Public Acts of 1994, as amended.
Section 4. Definitions
The Ordinance contains definitions for a variety of terms used throughout the Ordinance.
Section 5. Prohibited Conduct
The Ordinance makes it unlawful for any person to dispose of, store, collect or haul solid waste or recyclables except as authorized by the Ordinance.
Section 6. Authorized Waste Hauler
It is unlawful for any owner of a single-family generation site to utilize a waste hauler for collection and disposal of solid waste or recyclables except through an authorized waste hauler designated by the Township Board.
Section 7. Existing Contracts
Owners may continue to dispose of mixed waste and recyclables pursuant to an existing contract until the date the contract expires.
Section 8. Indemnification
The authorized waste hauler will indemnify the Township against various claims which may be made arising out of performance of waste hauling activities.
Section 9. Containment of Refuse
The Ordinance sets forth the requirements for containers to be used for solid waste and recyclable materials.
Section 10. Disposal Regulations
Solid waste and recyclable materials will be collected by the single waste hauler at least weekly in accordance with the collection schedules set forth in the Ordinance.
Section 11. Large Bulk Items
Owners of single-family generation sites will be allowed to make arrangements with the single waste hauler for the disposal of large bulk items.
Section 12. Hazardous Waste
Hazardous waste will not be collected by the single waste hauler.
Section 13. Collection Schedule
The schedule for the collection of solid waste and recyclables will be established by the Township Board.
Section 14. Rates; Billing for Collection
The owner of the single-family generation site shall be billed quarterly for collection and disposal in advance of service rendered by the single waste hauler.
Section 15. Selection of Designated Waste Hauler
The Township Board shall develop and approve bid specifications for the award of a single waste hauler contract.
Section 16. Enforcement
The Ordinance shall be enforced by the Armada Township Ordinance Enforcement Officer or other designee appointed by the Board.
Section 17. Violation; Penalty
Violation of the Ordinance is a misdemeanor.
Section 18. Repeal of Conflicting Provisions
All Ordinances and Resolutions in conflict with the Ordinance are repealed.
Section 19. Severability
In the event any provision of the Ordinance is deemed to be invalid, the invalidity shall not affect the remaining provisions of the Ordinance.
Section 20. Publication
A true copy or a summary of the Ordinance shall be published within 30 days after adoption by the Board.
Section 21.Effective Date
The Ordinance shall take effect 30 days from the date of publication.
A copy of the Ordinance may be purchased or inspected during regular business hours at the Armada Township Clerk’s Office located at 23121 Main Street, Armada, Michigan 48005. A copy of the Ordinance is also available for inspection on the Armada Township website at www.armadatwp.org.
