PUBLIC NOTICE

Oakland Township logoOn November 10, 2020, the Charter Township of Oakland Board of Trustees approved the second reading and adoption of the Attempt To Commit Crime Ordinance No. 110. The Ordinance effective upon publication is as follows:

ORDINANCE NO. 110

ADOPTED: 11/10/20, EFFECTIVE: 12/9/20

ATTEMPT TO COMMIT CRIME ORDINANCE

THE CHARTER TOWNSHIP OF OAKLAND ORDAINS:

AN ORDINANCE TO ADOPT MCL 750.92 BY REFERENCE AND TO PROVIDE PENALTIES.

ARTICLE I – TITLE. This Ordinance shall be known as and may be cited as the “Attempt to Commit Crime” Ordinance.

ARTICLE II – PURPOSE AND INTENT. This is an ordinance to adopt MCL 750.92, titled “Attempt to Commit Crime” by reference and to provide penalties for a violation of that Section, being Public Act 328 of 1931.

ARTICLE III – ADOPTION BY REFERENCE. Ordinance Number 110 shall read as follows:

A. Adoption. MCL 750.92 is hereby adopted by reference.

B. Penalty. A person who violates this Ordinance shall be guilty of a misdemeanor, punishable by imprisonment for not more than forty-five (45) days or a fine of not more than Five Hundred Dollars ($500.00) or both.

C. Application. The Township shall not enforce any provision of MCL 750.92 for any crime for which the maximum period of imprisonment is greater than ninety-three (93) days.

ARTICLE IV – SEVERABILITY. If any Section, subsection, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent portion of this ordinance, and such holding shall not affect the validity of the remaining portions of this ordinance.

ARTICLE V – SAVINGS. All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law in force when they are commenced.

ARTICLE VI – REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect.

ARTICLE VII – EFFECTIVE DATE. This Ordinance shall be published in full in a newspaper of general circulation in the Charter Township of Oakland qualified under State law to publish legal notices and shall become effective upon publication, as provided by law.

This Ordinance is hereby declared to have been adopted by the Board of Trustees of the Charter Township of Oakland at a meeting thereof duly called and held on the 10th day of November 2020, and ordered to be given publication in the manner prescribed by the Charter of the Township of Oakland.
