A regular meeting of the Charter Township of Oakland Board of Trustees was called to order on Tuesday, March 28, 2023 at 7:00 PM in the Township Hall, 4393 Collins Rd, Rochester, MI.
PRESENT: Robin Buxar, Supervisor; Dave Mabry, Clerk; John Giannangeli, Treasurer; Jack Elder, Trustee; Jeanne Langlois, Trustee; Lana Mangiapane, Trustee
ABSENT: Andy Zale, Trustee
THE FOLLOWING MOTIONS WERE MADE AND PASSED:
1. To approve the agenda as amended.
2. To approve the Consent Agenda as read.
3. To appoint Leonard Kutschman to a permanent position on the Zoning Board of Appeals to fill an open term ending September 2025.
4. To approve the Resolution to make the Veterans Tribute of Oakland Township a Charitable Organization for the purpose of obtaining a Charitable Gaming License.
5. To approve Resolution 23-05 supporting the submission of Land and Water Conservation Fund Grant application LW23-0032 for Stony Creek Raving Nature Park Access Improvements which is to be matched by financial commitment and donations of $340,200 for a total $680,300 project cost.
6. To approve Resolution 23-06 supporting the submission of Michigan Natural Resources Trust Fund Grant Application TF23-0084 for Stony Creek Ravine Nature Park Access Improvements which is to be matched by financial commitment and donations of $380,300 for a total $680,300 project cost.
7. To approve the requested amendment to the Cloisters at Oakland Homeowners Association Master Deed as presented by the Cloisters at Oakland Homeowners Association (“HOA”) on March 28, 2023, based upon the following findings: (1) the HOA’s Application for Amendment to the Master Deed is found to be substantially complete and (2) the HOA has provided adequate evidence to show that the safety path/boardwalk running north and south along Brewster Road between the southerly line of the safety (bike) path running east and west along Silverbell Road and the southerly boundary of the Condominium as shown on Oakland County Condominium Subdivision Plan No. 1325. Replat No. 6. is determined to be a danger, hazard, or blight, which cannot be remedied; conditioned upon the Cloisters HOA remaining solely responsible and liable for the safety path/boardwalk until such time as it is removed in its entirety, with removal to occur within ninety (90) days of the adoption of the proposed Master Deed Amendment and, further conditioned upon the Cloisters HOA accepting full responsibility for the continued maintenance, repair and other obligations as set forth in the Master Deed should said safety path ever be constructed in the future; and authorize the Township Supervisor to execute any and all documents to accomplish this.
8. To increase the maximum wage range by 4% for all employee hourly rates and salaries effective 04/01/2023, excluding the salaries for the elected and appointed board commissioners to remain the same.
9. To have Attorney Dan Kelly to write a Township opposition to MCR 7.202, change regarding governmental immunity cases for us.
10. To cancel the Board of Trustees meeting on April 25, 2023.
11. To adjourn the meeting at 9:03 PM.
